Official Rules

 

NO PURCHASE NECESSARY.  PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.

 

ELIGIBILITY:  The New York Red Bulls College Night Photo Contest (“Contest”) begins on September 19, 2012 at 7:00 PM and ends September 19, 2012 at 9:00 PM (the “Promotion Period”).  The Contest is open to College students with valid game tickets attending the Sept. 19, 2012 match between the New York Red Bulls and Sporting Kansas City at Red Bull Arena, that are legal residents of the State of New York, New Jersey or Connecticut, and that are 18+ years of age or older at time of entry.  Void where prohibited.  Employees of Red Bull New York, Inc. (“Sponsor”), Major League Soccer, LLC (“MLS”) and Soccer United Marketing, LLC (“SUM”, and collectively with Sponsor and MLS, the “MLS Entitles”) and each of its/their respective parent companies, subsidiaries, affiliates, advertising agencies, public relations agencies, prize suppliers, including any vendors providing services in connection with this Contest (collectively, the “Sponsor Affiliates”), and employees, agents, directors, officers (including members of their immediate family – i.e., spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren – or same household) of Sponsor or any Sponsor Affiliates are not eligible to participate. 

 

TO ENTER:  During the Promotion Period, you may enter the Contest as follows: Take a picture of your college crew (up to 6 people) enjoying the match at Red Bull Arena on Wednesday, September 19th. Upload it to Instagram (available on iPhone and Android devices) and include the tag @NewYorkRedBulls and the hashtag #RBNY when you upload your picture to Instagram. Limit one (1) entry per person (including, as applicable, household, email and/or phone number) regardless of method of entry.  No mechanically reproduced entries of any kind permitted. Illegible and incomplete entries are void. Sponsor is not responsible for lost, late, misdirected entries or entries not received regardless of cause. In the event of a dispute over who submitted an online entry, the entry will be deemed to have been submitted by the authorized account holder of the Instagram account that originally submitted the winning entry. The authorized account holder is deemed to be the natural person who is assigned to such account by Instagram. 

 

REQUIREMENTS OF ENTRIES:

 

Entry may not contain, as determined by the Sponsor, in its sole discretion, any content that:

 

•        is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;

 

•        promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;

 

•        is obscene or offensive; endorses any form of hate or hate group;

 

•        appears to duplicate any other submitted Entries;

 

•        defames, misrepresents or contains disparaging remarks about other people or companies (or their goods or services);

 

•        contains trademarks, logos, or trade dress (such as costumes, distinctive packaging or building exteriors/interiors) owned by others, without permission; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;

 

•        contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission;

 

•        contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;

 

•        contains look-alikes of celebrities or other public or private figures, living or dead;

 

•        communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or

 

•        violates any law.

 

PUBLICATION AND ASSIGNMENT OF RIGHTS TO SUBMISSIONS: By entering the Contest, each entrant agrees that his or her submission is an original work of authorship and he or she owns all right, title and interest in the entry as of the date of submission.  Entries cannot defame or invade the publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights.  If the entry contains any material or elements that are not owned by the entrant and/or which are subject to the rights of third parties, the entrant is responsible for obtaining and has obtained, prior to submission of the entry, any and all releases and consents necessary to permit the use and exhibition of the entry by Sponsor, the Sponsor Affiliates and the other MLS Entities in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the entry.  If any identifiable person appearing in the entry is under the age of majority in his/her state of residence, the parent or legal guardian is required to provide permission.  Sponsor reserves the right to require proof of these permissions in a form acceptable to Sponsor from any entrant at any time.  Sponsor reserves the right to disqualify any entry for any reason, including any entry it deems to be offensive, inappropriate, not in keeping with Sponsor’s image or that is otherwise not in compliance with these Official Rules, in its sole discretion. 

 

By entering the Contest, entrants agree to assign all right, title, and interest, including copyright rights, in the entry to Sponsor and grant permission for Sponsor, Sponsor Affiliates and the other MLS Entities and their respective designees to publish or publicize all or part of their entry, including but not limited to entrant’s name, likeness and photo, for prize winning notification purposes in stadium, in whole or in part, for advertising, promotional and trade or other purposes in conjunction with this and similar promotions in any and all media now known or hereafter developed, worldwide in perpetuity, without notice or permission and without further compensation, except where prohibited by law.  Without limiting the foregoing, entrants grant to Sponsor, Sponsor Affiliates, and the other MLS Entities the irrevocable, perpetual, worldwide, royalty-free permission to reproduce, distribute, transmit, display, perform, use, and create derivative work from their entries for any purpose and in any manner and medium ,including, without limitation, any and all media developed hereafter.

 

JUDGING: A panel of New York Red Bulls appointed judges will judge all eligible entries received.  Eligible entries will be judged on the following basis: New York Red Bulls Spirit = 50% and Creativity = 50%.  During the match, the entrant(s) who submitted the entry with the highest score based on this criteria, as determined by the judges in their sole discretion, will be the potential winner(s) (each a “Winner”), subject to verification of eligibility and compliance with the terms of these Official Rules.   Sponsor reserves the right to not award the prize if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries.  The decisions of Sponsor are final and binding on all matters relating to this Contest.  Odds of winning depend on the total number of eligible entries received.  Limit one (1) Prize per person, family and per household.   

 

PRIZES:  The following prizes, in the quantities noted and having the listed approximate retail value (“ARV”), will be awarded to the winner.  The total ARV of all prizes is $3,000.

 

1. Prize (2): Field seats (up to 6) to the RBNY vs. Sporting Kansas City match on October 20, 2012 (up to ARV: $3,000)

 

Prizes are awarded "AS IS."  Neither Sponsor, the MLS Entities nor the Sponsor Affiliates make offer any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) in connection with this Contest or any prize.  Prize details and availability are subject to change, in which case a prize of equal value may be substituted at Sponsor's sole discretion.  Prizes consist only of the items listed, are non-transferable, with no cash redemption or substitution except at Sponsor's sole discretion.  Federal, state, or local taxes on prizes, if any, and any other costs, fees or expenses not listed above are the sole responsibility of each winner. Transportation to and from Red Bull Arena to collect/enjoy the prizes is not included.

 

NOTIFICATION: The Winner will be notified through Instagram (i.e.. through a comment by Sponsor on the winning entry’s photograph) with an email address where the Winner will be prompted to submit his/her user name and actual photograph file. To claim the prize, Sponsor will require the Winner to complete, sign, and return Affidavit of Eligibility/Liability Release/Publicity Release forms, and other applicable documents, which may require a social security number, postmarked within five (5) days of the date on the notification.  At Sponsor’s discretion, winners may be required to produce picture or some other form of proper identification to claim any prize. Sponsor reserves the right to substitute any prize with prize of equal or greater value. If a potential winner cannot be contacted, fails to timely claim the prize, is disqualified, fails to timely execute and return any required forms, or if the prize notification is returned as undeliverable, an alternate winner will be selected from other potential winners and/or by random draw from all remaining eligible entries. If by reason or printing or other error, more prizes are claimed than the number of prizes set forth in these Official Rules, a random drawing will be held to award the advertised number of prizes in the relevant category.  Under no circumstances will more than the advertised number of prizes be awarded.   

 

PUBLICITY & MARKETING: Acceptance of any prize constitutes permission to the Sponsor to use winners’ name, voice, Instagram handle and other monikers, statements, image and likeness for purposes of advertising and trade, in any medium, without further compensation or notice, unless prohibited by law.  Submission of contact information in connection with this Contest (whether or not required), including mailing address, phone number, and email address during entry constitutes permission for Sponsor to add entrant to Sponsor’s customer database and to contact entrant in the future for promotional and other reasons.  You may opt-out of receiving such communications as set forth in Sponsor’s Privacy Policy (located at www.newyorkredbulls.com) or as provided within any such marketing materials (e.g., using the “Unsubscribe” feature provided in the footer of Sponsor’s emails).

 

NO LIABILITY & INDEMNIFICATION:  Sponsor, Sponsor Affiliates and the MLS Entries (collectively, the “Released Parties”) are not responsible for and entrants release each from any failures of any kind (whether caused by computer, technical, or human error) which may either limit the entrant’s ability to submit an entry, claim a prize, or otherwise participate in this Contest, or Sponsor’s ability to include all eligible entries, conduct random drawings, notify potential winners, or otherwise execute this Contest in the manner intended.  Entrants further release and agree to indemnify the Released Parties from any and all liability, claims or actions of any kind whatsoever arising from injuries, damages, or losses to persons or property which may be sustained in connection with this Contest including, but not limited to: (a) the receipt, ownership or use of any prize awarded; (b) any travel or prize-related activity; (c) any typographical or other error in these Official Rules or any other materials disseminated by Sponsor; and (d) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with any equipment, systems, networks, lines, satellites, servers, computers, or providers used by an entrant or Sponsor. 

 

OTHER TERMS: Decisions of Sponsor on all matters related to the Contest are final.  Sponsor reserves the right to cancel or modify the Contest for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the Contest, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Contest as determined by Sponsor, in its sole discretion. Sponsor reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in these Official Rules. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL & CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES FROM ANY INDIVIDUAL MAKING ANY SUCH ATTEMPTS TO THE FULL EXTENT PERMITTED BY LAW. 

 

WINNER LIST:  To obtain a list of winners (available after September 20, 2012), send a self-addressed, stamped envelope (residents of Vermont may omit return postage) to: New York Red Bulls, 600 Cape May St. Harrison, NJ 07029.   Requests must be received by September 28, 2012.
